Eastern District of NY Finds Consumer Failed to Allege RJM Acquisitions, LLC Violated FDCPA
In Ehrich v. RJM Acquisitions, LLC (E.D.N.Y. 2009), a plaintiff consumer brought a class action against RJM Acquisitions, LLC, alleging violations of the FDCPA through debt collection letters sent to consumers. The District Court for the Eastern District of New York granted RJM's motion to dismiss the complaint.
Over the course of one year, the plaintiff consumer received debt collection letters from RJM, which the consumer alleged failed to comply with the notice requirement of the FDCPA. The consumer alleged that the letters violated the act because they used language that "overshadow[ed] the 30-day notice by making offers and by including various notices that do not pertain to the consumer." The consumer also alleged that RJM made false, deceptive and misleading representations because they "falsely suggested that payment [of the debt] would not affect the consumer's right to dispute the debt," and used unfair or unconscionable means because they communicated "with the consumer despite their failure to give the required notices."
In considering a motion to dismiss, courts construe complaints liberally, but the complaint must contain sufficient factual matter to state a claim that is plausible on its face. Here, some claims that relied on letters sent to the consumer were time-barred by the statute of limitations, which states that an action to enforce liability under the FDCPA must be commenced within one year of the violation. However, the court found that the consumer's complaint failed to include the specific language that RJM used to violate the FDCPA, and did not connect the language to particular FDCPA provisions. The consumer also failed to provide the date of any communication from RJM aside from the initial letter sent to consumer.
Because the court found that the consumer's claims were legal conclusions without factual support, the complaint was dismissed without prejudice. However, the court granted additional time for the consumer to file an amended complaint.
